Overview

This continuing education activity, presented by a senior patient safety risk manager and an associate general counsel from a patient safety and risk management perspective, examines how patient nonadherence and noncompliance affect clinical outcomes and professional liability exposure. The program distinguishes compliance from adherence, identifies patient, treatment, and systemic barriers that drive nonadherent behavior, and reviews malpractice claims data (The Doctors Company MPL Patient Safety Data, 2011–2022) showing how patient factors such as insufficient documentation, communication breakdowns, and patient assessment issues correlate with paid claims and injury severity. Through a detailed case study of a delayed bladder cancer diagnosis, expert commentary, and a legal analysis of negligence, intentional torts, and damages, participants learn concrete strategies to improve communication, verify patient-reported history, recognize implicit bias, document refusals and nonadherence, and establish office procedures that improve patient outcomes and strengthen the defensibility of care. Please join us to learn how you can protect yourself and your practice from the unintended consequences of patients who are non-compliant and nonadherent.

Learning Objectives/Outcomes apply to all professions.

To obtain credit and a certificate of completion, learners must complete a program evaluation.


Objectives
At the conclusion of this activity, you will be able to:

  1. Document patient complaints, outcome resolution, and follow-up instructions when concerns arise
  2. Verify patients’ verbal medical history by requesting prior medical records when discrepancies occur
  3. Utilize strategies to improve communications with patients to help decrease nonadherence and noncompliance
